Binary Base (Pty) Ltd ("Binary Base", "we", "us", "our") is a South African private company (registration number 2026/397946/07) that provides professional websites, business email, and WhatsApp AI sales automation to small and medium businesses. By using our website, enquiring about our services, or entering into a service agreement with us, you agree to these terms.
We offer three primary service packages:
Specific deliverables, pricing, and timelines for each engagement are set out in the proposal or agreement signed between Binary Base and the client.
All prices are quoted in South African Rand (ZAR) and exclude VAT unless otherwise stated. Binary Base is not currently registered for VAT.
To enable us to deliver your project, you agree to:
Upon receipt of full payment for a project, all custom design and content created by Binary Base for that project is assigned to you. Binary Base retains ownership of its own underlying frameworks, code libraries, methodologies, and proprietary tools. We may display your completed project in our portfolio unless you ask us in writing not to.
Binary Base's total liability to you for any claim arising out of or in connection with our services shall not exceed the total fees you paid to us in the three months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential losses, including lost revenue or lost data. Nothing in these terms limits liability for fraud or death or personal injury caused by our negligence.
Our services incorporate or depend on third-party platforms (including Meta WhatsApp Business Platform, AI language-model providers, hosting infrastructure, and domain registrars). We are not responsible for outages, policy changes, or discontinuation of those platforms, and we will use reasonable endeavours to find alternatives if a critical platform becomes unavailable.
These terms are governed by the laws of South Africa. Any dispute that cannot be resolved by negotiation shall be subject to the jurisdiction of the South African courts.
We may update these terms from time to time. The "Last updated" date above reflects the current version. Continued use of our services after an update constitutes acceptance of the revised terms.
Refund & Cancellation Policy
Because website design and development work begins immediately after payment, once-off setup fees are non-refundable once work has commenced. If you cancel a project before any work has started, a full refund will be issued within 7 business days.
If Binary Base fails to deliver the agreed scope of work within a mutually agreed extended deadline, you are entitled to a pro-rata refund of the portion of work not completed.
Monthly fees for hosting, business email (Identity), or Pulse AI are charged in advance for each billing cycle. Subscription fees already paid for a current billing period are non-refundable — your service will continue to run until the end of that period after which no further charges will be made.
We do not charge cancellation fees or lock you into long-term contracts. You may cancel at any time (see section 12).
To cancel any Binary Base service, contact us by email at hello@binarybase.co.za or by WhatsApp at +27 78 043 8471 with your company name and the service you wish to cancel.
If you believe you have been charged incorrectly, please contact us within 30 days of the charge at hello@binarybase.co.za. We will investigate and, where a billing error is confirmed, issue a credit or refund within 7 business days.
